A Sydney father has been released from police custody after a home intruder died in his house during a struggle.
Francois Schwartz, 44, woke Sunday morning to the sound of his dog barking and confronted a barefoot stranger who had broken into his home in Harrington Park.
The pair then got into a physical confrontation in the lounge room, which ended when the 35-year-old intruder fell unconscious.
Neighbours attempted to perform CPR until paramedics arrived, but he was unable to be revived, according to the Sydney Morning Herald.
Mr Schwartz was interviewed by police but was released from custody on Sunday night.
Police are investigating the cause of the man’s death and whether the force used by Mr Schwartz was reasonable.
‘People are entitled to their home, and they’re entitled to use reasonable force to protect themselves and their property,’ Chief Inspector Shane Woolbank told the newspaper.
The deceased is still yet to be identified.
