In January 2011, mother-of-seven Lynette Daley died after spending Australia Day on Ten Mile Beach in NSW.
A court has heard the woman suffered fatal injuries from a violent sex act, The Sydney Morning Herald reports.
Forty-two-year-old Adrian Attwater has pleaded not guilty to the rape and manslaughter of 33-year-old Ms Daley.
Crown prosecutor Philip Strickland told the jury that Mr Attwater was in a relationship with Ms Daley. The mother had agreed to go camping with him and his friend, Paul Maris.
According to The Daily Telegraph, the group spent the day at the beach drinking. At around dusk, Ms Daley was allegedly raped by the two men in the back of a white troop, Mr Stickland said
Mr Stickland told the court that Mr Attwater allegedly “repeatedly and vigorously” sexually assaulted Ms Daley for a couple of minutes.
The barrister said Mr Maris was invited by Mr Attwater to join in on the sex act. Mr Maris has pleaded not guilty to aggravated sexual assault and hindering the discovery of evidence.
A jury heard the woman suffered lacerations to her genitals from an act involving a fist or a hand. Mr Strickland said the woman was too intoxicated to have consented to the aggressive sex.
The barrister also alleged that Mr Attwater noticed blood on his fist after a “wild sex session” and “the smell was terrible so we were going into the ocean to wash,” The West Australianreports.
In an interview with a detective, played at the NSW Supreme Court, Mr Attwater said of the group sex: “these things just happen, man, that’s it. Boys will be boys and girls will be girls”.
Speaking to police, both men said they thought the sex was consensual.
The defence barrister for Mr Attwater is expected to address the court today.
